Case Study #4: A Stalled Rezoning, a Timely Pivot, and a Better Site

The Assignment

W3 Planning & Research was retained to conduct development due diligence for an industrial company expanding nationwide. The assignment was to determine whether a prospective property could accommodate the company’s proposed operations.

The Challenge

The review encountered an immediate obstacle: neither the city nor the county initially identified the property as being within its jurisdiction. Further investigation traced the confusion to a recent annexation that had not yet been reflected in jurisdictional maps or assessor tax records.

Resolving that discrepancy uncovered a more consequential issue. Discussions with city staff revealed that the property owner had paused the rezoning process intended to change the property’s agricultural zoning to a mixed-use designation that would allow the client’s proposed uses.

The owner had not disclosed that the rezoning was on hold, leaving the client with the impression that the approvals were continuing to move forward.

The Finding

Annexation had changed the property’s jurisdiction, but it had not established the zoning needed for the proposed operations. The paused rezoning presented a critical barrier to proceeding under the client’s anticipated development plan and schedule.

The Outcome

With this information in hand, the client pivoted to a second property a short distance away that was ready to accommodate its needs. The alternative also offered an existing building, avoiding the time and expense associated with constructing a new facility.

The Risk

A property’s apparent readiness can depend on approvals that are incomplete, paused, or misunderstood. In this case, resolving conflicting jurisdictional information and verifying the actual status of the rezoning gave the client the information needed to change course early.

Time is money in an expansion program. Discovering the obstacle before committing further resources helped the client preserve both.

Our Approach

Because the issue was identified during the due diligence period, W3 Planning & Research was able to work directly with municipal staff to develop a path toward compliance.

The jurisdiction was exceptional to work with throughout the process. Staff were responsive, collaborative, and focused on finding a practical solution rather than creating unnecessary obstacles.

Working together, the team reviewed the manager’s apartment conversion, evaluated the associated clubhouse structure, and established the necessary steps to properly document and permit the improvements.

The early discovery of the issue provided sufficient time to resolve the matter before it could affect the transaction schedule.

The Outcome

With this information in hand, the client pivoted to a second property a short distance away that was ready to accommodate its needs. The alternative also offered an existing building, avoiding the time and expense associated with constructing a new facility.
